Terms & Conditions of Sale and Site Use

The agreement that applies when you use sleepingbeg.it.com or buy a sleeping bag from us.

Please read these terms carefully. By browsing this website or placing an order with SleepingBeg you agree to be bound by them. If you do not agree, please do not use the site or buy from us.

Definitions

  1. 1.1"We", "us" and "SleepingBeg" mean the business trading as SleepingBeg at 87 Cooks View, Lynchburg, Tennessee, 37352.
  2. 1.2"You" means the person visiting the site or purchasing goods.
  3. 1.3"Goods" means sleeping bags, liners, stuff sacks and any other products we supply.
  4. 1.4"Order" means a request to purchase Goods sent by email and accepted by us in writing.

Making a contract with us

  1. 2.1Orders are placed by email to [email protected]. An email from you is an offer to buy; a contract is formed only when we send a written order confirmation.
  2. 2.2We may decline an order, for example if stock is unavailable, a pricing error has occurred, or we cannot deliver to your address.
  3. 2.3You must be at least 18 years old, or have a parent's or guardian's permission, to place an order.

Product descriptions and temperature ratings

  1. 3.1We take care to describe each sleeping bag accurately. Colours may look different on screen, and weights and packed sizes may vary by up to 5%.
  2. 3.2Temperature ratings are laboratory measurements for a standard sleeper using a suitable sleeping pad. Actual warmth depends on your metabolism, clothing, food, shelter, humidity and wind. Ratings are a guide, not a guarantee of survival in extreme conditions.
  3. 3.3You are responsible for choosing equipment suitable for your trip and for carrying appropriate emergency gear in cold or remote environments.

Prices, payment and delivery

  1. 4.1Prices are quoted in US dollars in your order confirmation and include any applicable sales tax unless stated otherwise. Shipping charges are shown before you pay.
  2. 4.2Payment must be received in full before Goods are dispatched.
  3. 4.3Delivery times are estimates. Risk in the Goods passes to you on delivery; ownership passes once payment is received in full.

Returns and exchanges

  1. 5.1You may return unused Goods within 30 days of delivery. Sleeping bags must be clean, unwashed, unslept-in and packed in their original sacks with tags attached.
  2. 5.2Email us before sending a return. Unless the Goods are faulty or we sent the wrong item, return postage is your responsibility.
  3. 5.3Refunds are made to the original payment method within 14 days of us receiving and inspecting the return.

Workmanship warranty

  1. 6.1We warrant our sleeping bags against defects in materials and workmanship, such as failed seams, faulty zippers or baffle blowouts, for two years from delivery.
  2. 6.2The warranty does not cover normal wear, loss of loft from long-term compressed storage, burns, pet or animal damage, improper washing, or alterations.
  3. 6.3If a warranty claim is accepted, we will repair or replace the item, or refund the purchase price if neither is possible.

Limitation of liability

  1. 7.1Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence.
  2. 7.2Otherwise, our total liability for any claim relating to an order is limited to the price you paid for the Goods concerned.
  3. 7.3We are not liable for indirect losses, such as a cancelled trip or lost travel costs, that were not reasonably foreseeable when the contract was made.

Using this website

  1. 8.1All text, photographs, video, graphics and the SleepingBeg logo on this site belong to us or our licensors. You may view and print pages for personal use but may not republish them commercially without written permission.
  2. 8.2You must not misuse the site, attempt to gain unauthorised access, or introduce malicious code.
  3. 8.3We aim to keep the site available and accurate but do not guarantee it will be uninterrupted or error-free.

Governing law and changes

  1. 9.1These terms are governed by the laws of the State of Tennessee, USA. Disputes will be handled by the courts of Tennessee, without affecting any consumer rights you have where you live.
  2. 9.2We may update these terms from time to time. The version in force when your order is confirmed applies to that order.
